    I think it's why O was agin' it, being a constitutional scholar and all.

    It'll definitely be challenged and I'd note that the current SCOTUS is not a friendly place for progressive values.

      Yes, it could really backfire if it ever got to the Court. People like Scalia would just be kneejerk against it for conservative reasons, and even liberals (should there be any remaining on the Court) could well look at it as very intrusive and not at all the right precedent.

      It should be put out to pasture now before it causes nearly endless litigation, doubt and expense. This was a Republican idea to featherbed the insurance industry in the first place. Why anyone on our side is defending it is totally beyond me.
