    •  Churches don't have the same disclosure (0+ / 0-)

      requirements other Non-Profits do, and so have tighter restrictions on "advocacy".

      We just did this last Fall, Burrow Owl.

        Keep it under 15% of total expenditures and they're fine.  Provided that remains the case, there's nothing wrong w/ charities engaging in issue advocacy.

          Although, I seem to recall that the IRS wouldn't give a hard and fast ruling on what percentage constituted "substantial"....it's pretty obvious that the Catholic Church isn't approaching any reasonable meaning of the word.

          Still, they are limited.

            Case law indicates 10% is totally fine, and if the charity made its 503(n) (IIRC) election, then there's a statutory "safe harbor" that's in the 10-15% ballpark. (I used to audit charities, but it's been a while so I'm a little rusty).  Churches can't make the 503(n) election, but it'd be tough to see the IRS or a court punishing a church for making an identical % of advocacy expenditures that a non-religious charity could.
