    It looks like that would be determined by the HHS Secretary, who presumably would use the information gathered by the Dept. of Labor.  If HHS determines that a "typical" employer's plan includes exceptions (and they usually do), then there would be exceptions to the essential services.  But it looks like the scope of that is up to HHS.
