    arbitration under rules originally set up to be fair to labor.

    State arbitration rules tend to require choices of arbitrators from limited pools of people who routinely-- this is not a recent phenomenon of the last few years--maintained industry ties.  It also in many cases if AAA rules are chosen can be expensive, the $750 set by the court doesn't even cover the initial fee.
