    lawyer from the beginning, clerking for Rehnquist and serving under Reagan. It is not a surprise that he's conservative.

      doesn't make him unacceptable in itself. Advising on Bush v. Gore does.

        Rehnquist never met a civil rights plaintiff he couldn't thwart, or a government intrusion or death sentence he couldn't approve.  He was for a police state and against government regulation of business.  Unfortunately, much of this approach to adjudication has been deemed to be in the "mainstream" in the last decades, but if we want judges with "empathy" -- and Rethugs notwithstanding, I think we do -- we have to break the Rehnquist/Roberts/Alito/Thomas/Scalia mold. Frankly, I don't think we'd have outlawed prohibitions on mixed marriages yet if there were five Rehnquists on the court in 1967. (It's amazing to me that Obama's reference to the word "empathy" as a quality judges should have should have generated controversy, but that just shows either how the media can buy into Rethug horse puckey, or how pitifully sad the public that bought into that as a "criticism" has become)
