    But further down in the article it says:

    "Discrimination based on factors such as one’s sexual orientation or parental status violates the Equal Protection Clause of the United States Constitution. Therefore, discrimination against enumerated classes of persons set forth in the Virginia Human Rights Act or discrimination against any class of persons without a rational basis is prohibited," McDonnell said.

    It's unclear whether this was simply a statement he issued or part of the executive order.

    What is clear is that he arrived at this "conclusion" kicking and screaming.

      Although it appears McDonnell has not altered his executive order, this is the first time I have seen a real conservative claim the 14th Amendment trumps any specific state law. In the past, judges have argued that anti-discrimination laws must specifically state the classes that are protected. McDonnell is actually being far more progressive - probably unintentionally - than the law would require.

      Don't know that it will actually help VA LGBTs that much, but it begins the tearing down of the arguments in favor of anti-LGBT legislation.
