    "Opponent of free speech" is seriously taking an attack on a Democratic member of the administration, who is a potential supreme court pick too far.  

    Reverse argument ad hominem.

      All I meant is that you shouldn't use that level of hyperbole to viciously attack someone who is a valuable member of the Democratic Party/Obama Administration team.  

      As far as it being true, you haven't presented any evidence or reasoned argument as to why you think she opposes the first amendment, so there really is not argument to make against it, other than to flat say you are wrong and have no basis for stating it.

        These seems to be some basis for wondering about Elena Kagan.

        Why is it seemingly impossible to find even a single utterance from her during the last decade regarding the radical theories of executive power the Bush administration invoked to commit grave crimes and other abuses?  It's possible that she said something at some point, but many hours of research (and public inquiries) have revealed nothing -- other than when she endorsed the core Bush template during her Solicitor General confirmation hearing.

        I hope there is no further moving to the right in the Obama administration.  That is a change I don't want to see.

            Bush put limits on where we could exercise free speach during his Administration, and then there is the matter of spying on any citizen for undisclosed reasons, which also chills free speach.  You didn't connect those dots?

            I do fault anyone who has not spoken out against that, and many attorneys have, though we hardly hear of it since our media doesn't practice  principals of free speach either.
