    That's a loser.  It would be their public position in favor of gay marriage.  That would be, at least right now, a politically viable stalking horse/whispering tactic to use behind the public bluster against "judicial activism".

    Just talking politics here.  I am pro-gay marriage, and I believe we are close to a time when that becomes the view of the vast majority of Americans.  That time, as measured by the recent electoral losses, is not today.

      Traditionally nominees have refused to say where they stand on issues likely to come before the court. But the public can make a pretty good guess.

      ...a Supreme Court nominee that she doesn't have the right to marry.

      I don't recall anybody daring to tell Justice Thomas thate didn't have the right to marry his wife, but if Senators really want to go there, then by all means, let's let them go there.

      Let's have this conversation. And let's have it out in the open.
