  •  It does allow that. A cop can stop someone (0+ / 0-)

    saying they were swerving when driving, loitering or any of dozens of other pretexts.  This happens all the time to African Americans.  In fact an email between proponents of the law has become public in which they say this very thing.  They discuss how cops can just say someone was being too noisy and use that as a pretext to ask for their papers.

      If a city or county has an anti-noise ordinance, being noisy IS pretext for being pulled over.  My old hometown had one (not so much about music, but about people putting pipes on their car/truck exhaust to make lots of noise)

    •  The key statistic is how many people that (0+ / 0-)

      get stopped get a ticket and then get convicted.   It ain't a pretext then, it's probable cause.
