    I'm just saying that a congresman (whoda thunk) doesn't know what he is talking about.

    If the device failed its testing and was put into service, heads should roll.

    If the device has 260 failure-modes that are designed to fail to a safe state and require the replacement of the device, there is nothing inherently wrong with that. That's what you do, identify ways the device could fail and plan how to safely handle it.

    Failing a test is a completely different situation.
