    to consider not running for something to be political activity.

    The intent of that phrase was referring to tangible gains, like votes.  "Not running for office" is no more "political activity" than "not collecting stamps" is a hobby.

    Moreover, all of the established precedent of bribery, corruption rules, etc. involves "tangible" gains for the parties involved.  Both parties must receive tangible gains for it to be considered illegal.  "Not running for office" is simply not a "tangible" gain for the WH, and an unpaid advisory role for Sestak almost certainly isn't what the statute-makers had in mind with this law.
