    why not rule that "remaining silent" sufficiently invokes "the right to remain silent."

    On the waiver point, it seems they should never have reached that phase because once it was clear the suspect intended to not talk (i.e., by not talking) the interrogation should have ended.  

    To this bunch, outcomes matter more than the rule of law.
