    And seizing assets in order to insure a debt payment is certainly with in the law.

    However, the nationalizing of BP does raise a serious Constitutional question. When Truman did it to the steel industry back in '52 SCOTUS said, Oh no you can't. So while temporary Nationalization  has happened in times of war I will admit I am not sure if there is firm enough legal ground in this case for the US to do so.

    In the choice between changing ones mind and proving there's no need to do so, most people get busy on the proof.
