    ... courts applying the Constitution as it now exists to challenges of proposed amendments or processes. Federal courts would likely refuse to hear such cases under the Political Question Doctrine, following Coleman v. Miller (1939). That allows the real possibility of constitutional chaos until a new constitution is adopted ... with no guarantee the new constitution would be better than what we have.
