  •  "Caused by" is going to be tough here (1+ / 0-)

Because there's some level of voluntary-ish-but-coerced action.

    •  Uh-huh, and cause is the legal sea in which (0+ / 0-)

lawyers swim, even with independent contracting?

Periodically Wal-Mart is sued because middle management has forced employees to work off the clock or shaved numbers off their time sheets.  This is because of two of the company's mandates: 1) you must finish all the work that needs to be done while 2) not paying any overtime.

So a middle manager who feels his own job is threatened will cheat lower employees of their pay.  When the employees sue Wal-Mart, company always points to one of their other directives: overtime must be paid for.

Plausible deniability, it's not just for Reagan.

It's the same for WWE - they might have policies against substance abuse, but also expect the "independent contractors" to show up ready to perform at 100% every night - else you'll be kicked down the roster and eventually fired.

This is why I'm annoyed when people blame the wrestlers for "the culture".  It's not the performers that create this environment, it's the McMahons.
