    It doesn't change the fact that the Court in Darby did not ignore or decline to give legal effect to federalism or the 10th Amendment.  By calling it a "truism" they were pointing out that the 10th Amendment only makes express what was an unavoidable inference all along.

    Also, can you please point to some of those repeated, specific, non-inferential statements of the 10th Amendment principle in the Constitution prior to the Bill of Rights?

      Honestly ive done this too much to be bothered anymore.. ive been doing this since the early 80's.
      Well that and mostly i just changed the calipers on my moms truck and dont feel like it. No insult to you and im not "refusing" im just not doing it for the 10,000th time. Besides it will be good for you when is the last time you reread it?

      The whackjob argument the diarist (who is dear to me btw) is making is that anyone who brings up the tenth amendment is a far right wing nut and inherently evil. She doesnt get that the tenth amendment is the Core of the american system of government. It isnt a tacked on thought or feelgood note. It is the basic precept from which the rest of the constitution flows. Without it, and the other instances, the commerce claws and other "sidesteps" simply wouldnt be necessary.

      In other words i think in effect youre arguing my point though you believe you are siding with those who dont get that point.
