    Founding Father for the Roberts Court say that Marshall's views reflect the "original intent" that they wish to foist upon the nation.  After all, Marshall merely served in the Continental Army from 1776-1780 and was a member of the Virginia Convention who urged the ratification of the Philadelphia Constitutional Convention.  For the Roberts Court, "original intent" is whatever Scalia, Thomas, Roberts, and Alito say it is.

      You just defined what judicial activism actually is--making shit up and calling it law. Which, at the SCOTUS level, it unfortunately is, but with absolutely zero intellectual honesty. These are the most radical top government officials since Jeff Davis & Co.
