    He might have been drunk too, and not realized she was helpless, but when she calls and cries about the incident, he feels guilty, he thought she wanted to have sex, she probably did want to have sex, but she passed out while they were getting it on.

    Was there a prior conversation where she berated him for taking advantage of her? Maybe he likes her, and wants forgiveness. You don't get forgiveness unless you admit guilty.

    He doesn't sound  callous to me. I am a defense lawyer, and I think he walks. Worst case, he gets convicted of a lesser charge.

    And I can almost guarantee, when you read the entire transcript, you get a different view. I could be wrong. But I'd like to see the whole thing.

    Also, the fact that the phone call was surreptitiously recorded does not make it inadmissible in any state I am aware of. Maybe things are different in Colorado, but this claim sounds suspect to me. Cops and snitches are wired to get confessions or document drug deals all the time.
