    I thought that bit was one of the keys to the story. They couldn't very well trot out the "activist judge" canard when the judge in question was one of their own appointees. I'm just a little disappointed (OK, more than a little: a lot) that he caved and let them bring in the secret evidence. My guess is that the family will get a writ of certiorari from the Supreme Court, who will once again slap down the Shrubbery for overstepping its bounds. You'd think they'd have learned by now, after Hamdi and Rasul and all the rest. Heck, even the average puppy only has to be whacked with a rolled-up newspaper copy of the Constitution three or four times before he learns not to pee on the carpet.
