    Haven't even come close yet. The key case on this is Brandenburg v Ohio (1969) a unanimous decision by the SCOTUS. There is a very good summary in Wikipedia. The Court put the bar very high and elevated the First Amendment protection of provocative speech.

        We should go right up to the Brandenburg limit, which basically is "imminent" threat, "there he is! get him now!"

        This means it's OK to say "get him later!"   It's OK to have T-shirts with is face in the center of a target, and bumperstickers saying "Shoot Beck!,"  etc.  And of course it's OK to gloat and engage in other exercises of bad taste.  The actual point of which is not to encourage some nut to fulfill Beck's paranoid fantasy, but to force the issue about whether that sort of thing is acceptable in the first place.  

        But really what's needed is to fix Brandenburg by passing legislation to remove the "imminent" part and then forceing another court case up to the USSC to see if it can be made to stand.
