    I don't know the answer to that question although I very much hope that what you suggest is not true. I don't know the law, I haven't followed the case very closely, and don't have an opinion about what was going on in Mehserle's mind. I don't know whether this sets a precedent that other judges will follow. So many of these cases have always hinged on what the officer's state of mind was at the time.

    But still, I would hope that the judge based his decision on the law and the evidence. I will read the legal commentary that should be coming out and see if there's any consensus about it.

    I watched the video a number of times and still had no idea what happened. I couldn't make it out visually or aurally; it was all just a jumble to me.

      You can look in my diary history if you're interested.  the title of the first is you shot me I have a 4 year old daughter.  Those were about Oscars last words.  I've examined since before the shooting and those men were brutalized every step of the way then Oscar was murdered, and if this were to happen routinely to white people as it does black ones people wouldnt use the terms america and land of the free in the same breath.

        I am of course aware of the history of the police killing black men and getting away with it, and of the way the justice system is stacked against black men.  The justice system is very flawed; but the presumption of innocence is not one of the flaws. I believe we must take it very, very seriously. Any reasonable doubt has to favor the defendant, no matter who the defendant is.

        Although the pattern of these police incidents is very disturbing, in the courtroom each case has to stand on its own. It is not the place to consider or address the pattern.

        But as I said, I will read up.
