    By its own tradition, the Senate votes on rules annually. All that Article 1, section 5 of the Constitution has to say on how they choose to run things is:

    Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member.

    So, at any point in the past two years, 51 Democrats could have dropped the entire filibuster thing, but this was apparently unthinkable. One of the most devastating results of this is that the Waxman-Markey carbon trade bill that passed the House died in the Senate. Not to mention the gutting of health care reform, financial regulation etc - all of which could safely be blamed on the supposed need to get 60 votes for anything

      With the Republicans' record of obstruction to use against them, the Democrats fail to make the one change that could have saved our nation...our planet...and, most importantly, Democratic chances for re-election in 2010.
