    IN THIS COUNTRY routine DNA samples are taken from everyone arrested--arrested, not convicted.

    This was one of those things that almost snuck in under the radar in the summer of 2008 in VT.

    There was a plan to collect DNA from everyone picked up for any reason at the time of arrest. Someone on the Democratic State Committee caught wind of it, and brought it to the attention of a group who worked with the States Attorney to devise a compromise that actually makes sense:

    DNA can only be collected in felony cases when (a) the Attorney General has decided to prosecute and (b) probable cause is demonstrated. In addition, there are specific rules on retention and destruction of the DNA, implemented under judicial supervision.

    There was NO (emphasis on NO) opposition from the party leadership. It took an informal grassroots group moving very quickly to stop it.
