    A proposal doesn't have to win to be useful.

    Legislative proposals and legal challenges serve secondary and important goals: to generate publicity and recruit allies.

    This proposal will keep the issue in the media and get Pearce allies, much as the continuing lawsuits by Birther Queen Orly Taitz keep the issue of Presidents Obama's citizenship in the media.

    We can, and must learn from this. Every bit of legislation introduced to protect unions, increase the minimum wage, remove poisons fro our food, water and air, et cetera, can help us in the long run.

    It doesn't even need to be binding legislation.  Ever town that passes a resolution opposing the wars gets local publicity, even though the resolution can't effect policy immediately.

    Politics is a constant battle of visions.  We need short-term victories and long-term strategies.

    To see a great description of how things can get done this way, read The Waxman Report, by Congressman Henry Waxman.  He demonstrates how politics, oversight and legislation combine into real victories, even if they take several sessions of Congress.  Especially interesting  is the way he finally clobbered big tobacco.
