    Presidents Lincoln and Roosevelt both detained persons who were considered by them to be threats to America. They did this to protect American citizens and to protect those detained.

    If you're applying legal standards then you'll be continuously frustrated as these somewhat unique circumstances are different from common law.

    Maybe we should truck on over to namby-pamby land where we could find some self- confidence for you....ya jack wagon!

        gives the POTUS all that he needs to start hostilities. Congress can stop it if they feel obligated, but thus far neither the Republican nor Democrat led Congress has done anything about it.

        Unlike the historical examples cited previously, this conflict (or war) has involved two presidents - both seem content with letting these things continue.
