    eglantine part and parcel of our system - or what it's supposed to be, anyway. Until proven in a court of law, KSM is not guilty and, as a human being, he is entitled to certain rights - including being able to defend himself in court.

    Is he guilty? Almost certainly, yes. But until that point, being that he is in custody - as a Prisoner of War, for all intents and purposes - his human rights still stand.

    And just to get the Reductio ad Hitlerum out of the way...if he had been captured, he should have had an opportunity to defend himself in a trial.
