No, but he could be sued into bankruptcy for intentional infliction of emotional distress.

I'm pretty sure the First Amendment is no defense to IIED, because neither party is the gubmint.

            •  Why do people think that this incipient (0+ / 0-)

fascism--for which Arizona is a laboratory-- will be stopped by getting the government to arrest its intellectual authors, or somehow "make them stop"?

Rightwing terrorism never evokes that response.

Its like we are asleep, and are dreaming. I mean I include myself here. But we need a movement. A political act of murder requires a political response.

It's less about the actual nuts—they will remain nuts—as it is the people who tolerate them, who think they are cool, and who give them aid and comfort, and whose fandom supports them financially.

If Sarah Palin, Glenn Beck, JD Hayworth, Sharon Angle, et al. were as uncool as David Duke and Timothy McVeigh, they would still be just as nuts, but they (a) would never, ever get elected to anything anywhere, and (b) never have the money to do much damage.

If people don't change their mind about the peddlers of this kind of hate enough to put a dent in their opinion polling and finances, then they remain more powerful--and therefore more dangerous--than they otherwise would be.

Sure, they might get their power temporarily enhanced by crying martyr, but at the end of the day most of the votes and money come from mostly normal folks who are taking for granted safety in numbers. If there's any way to change that dynamic things get better.

That happened with Oklahoma City. The "militia movement" didn't do shit for 10 years and right wing paranoia decreased for a little while at least.

.... pretending to want to talk with them, and then ease into making comments such as "has anyone ever told you that you have nice buttocks?" and similar referring to whatever body parts you'd like to play with if you were gay and seeking to ask them over for some consenting adult recreation.

This usually gets them running away pretty fast.

          Go here for an example:

.... just enough on this side of the law that it's not actionable.

That however could change if we had the guts to do it.

For example by making funerals into "private space for the duration" so he could be kept out just as surely as a ranting stranger who walks into your back yard while you're having a family barbecue.

But frankly that evil bastard is useful to our side, because we can hold him up as an example of evil incarnate on the right, and force them to own him.   So I'd just as soon he live a long and hateful life, spewing his bile everywhere, doing one shocking thing after another.   More than one former member of the right wing became "former" after getting disgusted with Phelps.
