    Remember that Ted Kaczynski was found guilty but insane under US law post Hinckley.  (And, FWIW, Judy Clarke, the attorney who defended Kaczynski has already been assigned to Loughner.)  Moreover, even if Loughner is convicted, he will be able to use mental illness as a mitigating factor in the death penalty decision.

    Either way, it's important to realize that he'll never be free again; one way or another, he is going to die in custody.  The only question is what the cause of his death will be.
