    Her statements did not occur in isolation, but in the context of two years of gunning down democrats advocated by teabaggers as the answer to pressure Democrats on health care vote and more.  

    The question is not should she be prosecuted (i did not even research re any putative federal statutes), but were her statements a threat?

      for issuing what was interpreted as death threats with sniper's crosshairs.

      If a Muslim or African American man had done this, where would he be right now?

      Short answer:  In Jail or on Trail for 'incitement of violence" which resulted in precisely what the death threat implied.
