  •  Yes. Exactly my point. (0+ / 0-)

And just as "weapons not arguably relevant to service in a militia" are not protected by the operative clause, so accessories not arguably relevant to service in a militia are not protected.

Now one can reasonably argue both sides of whether, for instance, an extended capacity clip for a handgun is relevant to service in the militia.  But if the conclusion is that it's not then there is no constitutional bar to banning it.

    •  using that same construction then hi cap (5+ / 0-)

magazines for rifles are completely acceptable as are the factory stock magazines that depending on the weapon in question range from 8 in a full size .45 to 17 in 9mm our current military sidearm caliber.....

I am on the radical side and even I could be persuaded to ban hi cap pistol mags as long as the og mag size is legal...in other words, no arbitrary 10 round limit....whatever the manufacturer ships the gun with is the limit....Just as enforceable and makes much more sense to me.....

One can reasonably argue both sides of specific examples.

The point of my original comment in this thread was quite modest, I thought.  I was not attempting to say what regulations may be constitutionally permissible, only to establish that the function of the prefatory clause is to help illuminate that issue.
