  •  Scalia lost all credibility when he didn't recuse (6+ / 0-)

    himself from Bush vs. Gore, despite being close friends with Dick Cheney.

    And I still don't understand how Clarence Thomas, appointed by Bush Sr., was even allowed to be anywhere near that case.

    These two are a disgrace to the Supreme Court.

    •  We will have retrospective recusal of their CU (0+ / 0-)

      votes.  I think we can be fairly confident about this now.  Once Scalia's performance for the Baggers is made public and part of his growing profile of inappropriate SCOTUS behavior, the case for his recusals on a myriad of cases and/or his impeachment from the bench will begin to gain traction.
