    No one contends that congress cannot enact legislation that would accomplish these purposes.

    Given that two judges have already rules exactly that, your making a counter-factual claim here.  

    This is what we call begging the question.  You are assuming the result you wish to support your argument for the result you wish.  Clearly there are plenty of people contending that Congress cannot enact legislation that accomplishes these purpose, in this manner.

    Looking for leaders to oppose the tax-cutting freaks.

      could be structured to constitutionally accomplish these purposes and no one contends otherwise.  Single payer for instance is constitutional.  This question is being raised because of the way the mandate has being structured....form over substance.
