    ----in the context of the explosion of racism used by the right media to attack obama and do their political correctness dance the right wing think tanks have been working overtime.

    guys like breitbart and the talk radio team are fed shit like that constantly. the think tanks are always looking for angles like that. guys like breitbart don't have to do much work of their own, just like the GOP politicians who rely on staff made up of industry lobbyists and lawyers.

    breitbart or drudge might break it and then limbaugh and hannity and spawn take it and run and really spread it until it becomes an issue and distraction, but i'll be it started in the computer of some GOP/think tank operative.

    molehills into mountains within days.

    she also ought to sue the rest of the propaganda machine that spread it.

    Progressives will lose all major messaging battles until they picket the limbaugh/hannity megastations and boycott those stations' local sponsors.

        fox news, drudge, etc., and try to get copies of all of the video they received, who they spoke to, etc. to verify the story.  This is in federal court, so there's no journalist privilege.  If they got the whole video and aired the Brietbart-edited selections, they're just as culpable.  If they only got what Brietbart disseminated, they reveal themselves to be hacks.  What we call a win-win.

      support, Sherrod would probably die (of old age) before anything could come of that. She has the weasel in the center, the 'big money' will only help help him a little, he should be toast. He deserves worse.

      Sherrod has an ironclad case against him.  It doesn't matter whether he edited the video or even knew it was edited; she was a private figure so she doesn't have to prove negligence, only harm.  And losing your job is automatically harm.  Subsequent events don't matter; it's like getting a hernia if you work with heavy things, you don't have to prove you got it at work to get workman's comp.

      Doesn't get him off the hook, legally. She wasn't a public figure, so the onus is entirely on him to do the research to be sure he's not defaming her.

      Just watching a video someone handed him and saying "I believe!" doesn't qualify as due diligence.

      He's fucked, on that point.

      The only meaningful place his case has to maneuver in is the amount of harm done. But since he smeared her reputation nationally... he's screwed, I think.
