    Curious as to what that last part is going to mean.  If Congress can't use the General Welfare clause of Article 1, Section 8 Clause 1 to enact the law, then that chops one of the legs out from under it.  The Supreme Court ruled in Bailey v. Drexel Furniture Co. that a "tax" that was really a penalty in disguise was a no-no.  If this court is ruling that it's not a tax, that could spell another legal challenge on those grounds.

    The ruling itself is not a surprise, nor is it a big victory.  We all know this is going to end in the Supreme Court, and any decision in any court shy of that is just a temporary victory for either side.  

    A desperate disease requires a dangerous remedy.
