    She formally alleged it in a complaint.   The existence of tape may not be information provided to them for purposes of providing legal advice.  Just don't know. The defense may raise that, althought it likely would be in a bar complaint.

      and it's kind of complicated.  Regan fired her lawyers before Fox settled with her for just shy of $11 million, and now the lawyers are suing Regan because they want 25% of the settlement.  They filed affidavits with the court describing their efforts to authenticate Ailes's voice on the tape and other matters.  I'm not clear exactly what happened next, but it seems there was a gag order on those affidavits that was not enforced.  The Times reporter went down to the courthouse, asked for the transcripts of the lawyers' lawsuit, and voila, there was all the damaging information right out in the open.

      Apparently the documents have now been sealed and no one else can gain access to them.
