      That the House already had its own counsel. I thought you were suggesting that meant they didn't need outside counsel.

      •  They don't need outside counsel, but, they have it (0+ / 0-)

        all the same. All they need is enough to get it before the court. Every hate group in the country will be filing Amicus Briefs, and even some of those exterior to the country, like the Papacy, will do so via in country agents like the council of bishops. Huge numbers of attorneys, interns and aids are scouring any and every source while we speak trying to find ways to to argue something other than the bible and the fact that gays are icky. Whole forests will be cut to furnish the paper for the hater briefs.

        Expect something like "see, 'full faith and credit', and nobody is more full of faith than the Pope, and he says ... . After all, if you are going to rely on something as old as the Constitution and most of the cases determining when the government may discriminate against a class of persons, then you should rely on Leviticus too, because it is even older."

          Given the number of cases that are out there.  And amicus briefs are irrelevant if the House itself isn't doing the principal work; the outside groups don't have standing.

          •  The House is unlikely to be a party to too many (0+ / 0-)

            cases, DOMA is something of a unique situation in being both so outrageously over-the-top unconstitutional and yet so deeply beloved on such a visceral level by so many open and closet haters and hate-mongers that the house feels compelled to defend it.
