    And it's something a lot of people should be very aware of, pre-clearance does not necessarily apply to areas where there are large minority populations.

    The best example is New Mexico, the state does not have to go through Section 5 pre-clearance, even though the state itself is majority-minority.

    This is a bit off-topic for the VRA, but it's worth mentioning, it's why a state like New Mexico actually tends to see a surprisingly small amount of racially divided electorates even though there are plenty of other places that see them (and, more specifically, why a Heinrich vs. Balderas primary, for example, won't be fought along racial lines in the same way that other races in places with significant minority populations will).

      To add on to that, the test for requiring preclearance was that, in 1964, less than 50% of the VAP in the jurisdiction were registered to vote or actually voted in that year's presidential election. Additionally, a "test or device" restricted voter registration or voting in that jurisdiction. Hence, not all areas with large minority populations are covered.

      Also, there's a procedure to "bail out" from coverage by Section 5.
