    A FOX affiliate already went to court (when two reporters who were fired claimed they were protected by Florida's whistleblower statute - the station had squelched their story on rGBH in milk after Monsanto wrote to Roger Ailes) and the court held that, in essence, the media can legally lie:

    In a stunningly narrow interpretation of FCC rules, the Florida Appeals court claimed that the FCC policy against falsification of the news does not rise to the level of a “law, rule, or regulation,” it was simply a “policy.” Therefore, it is up to the station whether or not it wants to report honestly.

    Here, Ms. Kelly's wanton failure to report something newsworthy doesn't even rise to the failure of lying.  Maybe we should move on and let the Justice Department go after Ensign . . . and perhaps Coburn for conspiracy.
