    What does it matter when judges refuse to acknowledge the law? Habeus Corpus does not exist in this country unless you're rich- see Strauss Kahn and Bradley Manning- so why should any other law be enforced?

    The judge is a Clinton appointee, and clerked under Tom C. Clark (a Truman appointee).

    From my understanding of previous Supreme Court decisions, the extent of Free Speech extends to the point when violence/threats occur.

    Hope the Justice Dept appeals the decision to FACE, or at least puts a stronger effort into its argument. The judge is a liberal judge, and seems to be basing his ruling on protecting 1st Amendment above that of federal law.

      Somehow the necessary and effective legal maneuverings or approaches haven't yet been hit upon and meanwhile we are so far behind where we were 40 years ago right after RvW, it's staggering.

      I think, as a commenter above noted, that far too few people really understand what's at stake until they or a loved one are in need of such a service. Then it all changes. The only way that judge could have ruled as he did (esp. being liberal) is if he could simply not imagine the impact (immediate as well as broader) of threats of this nature on both providers and users of a legal service that is under siege.

      But that makes me so angry. Why? Why? Why can't someone imagine this? Is it so f*cking hard to picture the need to have a dead fetus removed and the horror of being told, "sorry, gotta wait til your body expels it through labor--hope you don't hemorrhage. We'll do everything we can for you once that happens... Why? Oh, b/c someone somewhere thinks this is about babies...Well just have to cross our fingers that you're still fertile afterwards..."

        I do not think that is what is at issue here.  This is not an effective argument.  This is about culling fetuses alive or not.  People and society as a whole cannot afford to properly support every fetus.

          in recent history wherein a woman has had a fetus die after the 2nd trimester and needed to have it removed and was refused the procedure due to the fact that it qualified as a "late term" abortion, despite the health risks that increased as the fetus was decomposing inside of her. There are many reasons for a late term abortion and this is one of them. The fact that real women have been denied this procedure for this very real reason (as well as for other very real and equally legitimate reasons) due to our collective but totally non-medically based squeamishness about late term abortions is one very important issue amidst many. My scenario wasn't meant to be exhaustive and you are welcome to add to it.
