      To clarify, he is now serving as  Legal Adviser of the Department of State but was previously served in the Clinton Administration as as Assistant Secretary of State for Democracy, Human Rights, and Labor, arguably a higher position.

      Actually I wonder if his present position is a place holder to keep him on tap for a SCOTUS appointment should the opportunity arise, in the last 2 rounds he was short listed but perhaps a bit too controversial for appointment at the time.

      But now, having rendered an opintion that would likely be the basis of the the defending it's actions to capture OBL on the basis of International Law, the rightist claims that his opinions in this domain would weaken US sovernty and securety are effectively neutralized and it would be the fool who challanged him on that basis in a confirmation hearing.

      Koh is definately an excellent prospect for SCOTUS given his professional history including Dean of Yale Law, prior/current government service and distinguised standing on issues of human rights and international law.

      And, and unapologetic progressive.
