    ... then they're not really making a false representation.

    I.e. if the state of Wisconsin says that candidates must be affiliated with their parties for 1 year prior to running as a member of that party, then the fake candidates would have had to have registered back in early-ish 2010.  If on the other hand Wisconsin law says you only have to register 10 days in advance of running for office under a party ticket, then that's all you have to do.

    Unfortunately to my mind, too many states have gone to this "open primary" system and have taken away from a Constitutionally organized assemblage of people their rights to associate as they see fit - i.e. to have closed primaries and to select on their own terms their party's candidates.  In theory this is a protection against party machines and districts where only one party can reasonably put up a viable candidate; in reality it allows ratfucking to occur.

      There is no party-based registration in Wisconsin.

      The candidate application contains a field asking for the candidate's party affiliation.  Falsely tating "Democrat" on the form may in fact be grounds for a felony charge.

      The state party should try to dissuade these clowns from running by pointing this out prominently.
