    Just a passing question:

Why did not Judge Bradley file a formal complaint and begin the process of having him both arrested AND removed from the bench?

After all, he could not use the usual threats against her if she turned him in - she being a judge herself and cognizant of the rules and of the punishments for assault.

That question needs to be answered - of course, after Prosser is both removed from the bench and prosecuted for assault.

Yeah there are definitely a few questions remaining. hopefully a thorough investigation ensues and justice is served quickly! As much as I hate Prosser, it would be a relief to find out this was a hoax. Sadly, I doubt it is, since this man has a history of these kinds of actions.

      •  It's not a hoax.... (0+ / 0-)

He hasn't denied it -- just refused to comment. Something happened or there would have been an emphatic denial.

you may not like him but that does not make him a bad person. If he had attacked or threatened a fellow justice, and there are witnesses then why is she not pressing charges?

You don't have to prove that you are not guilty, the aggrieved party has to prove that you are guilty, that is how it works.

Thats the only part of this story that confuses me. Since this happened at the Capitol, does anybody know if this is solely under the jurisdiction of the Capitol Police, or does Madison and/or Dane County have jurisdiction? Because from what I understand, Capitol Police Chief Charles Tubbs is aware of the situation, and has addressed it with the WI Supreme court. So perhaps there is an investigation in progress, and statements or evidence is being gathered to bring charges? Not sure. Doesnt it seem kind of like the situation with Anthony Weiner though? You know, where everyone questioned why he hadnt contacted the FBI or anybody about being hacked... We will have to see how this plays out I guess. Oh, to add one thing, the fact that he has a history of misogyny DOES make him a bad person in my opinion. Of course, that doesnt mean he is guilty of these specific allegations, but it would indeed be in character.

protect the institution when one of their number acts out abominably.

Whether or not Prosser will be protected by the Fitzswalkerstanis, something he may be assuming since he is one of their boys, and the money for the election came in to make sure their boy had the possibility of absolute control of that Bench, he may be protected at least for awhile by the arcane customs of lawyers who handle their internal profesional brawls, not usually the literal kind, through legal disciplinary processes, which are almost never public. He may have thought that the recent election protected him from the consequences of his actions, to a degree that he could bully the women of the court enough to make himself the effective chief justice.

If you read Bar journals and the like, you wouldn't know something was happening from the date a complaint is filed until the date it is over and the decision is issued, no matter how hot the proceeding is, unless some one of the parties refuses to have it handled professionally.  That may be the decision here, or they may be looking at the degree to which this event could if made public damage the entire institution. Which judges care a lot more about than the conduct of any one of their number.  All those 'no comment' bits suggest a proceeding is in the works, and they know from the number of inquiries that this one is not going away.

            1. He has done it before.

PROSSER’S HISTORY WITH FELLOW FEMALE JUSTICES

The latest alleged incident involving Wisconsin Supreme Court Justice David Prosser can't be viewed in isolation. Last year, Prosser exploded at Chief Justice Shirley Abrahamson in a closed door meeting, calling her a "bitch" and threatening to "destroy" her.

That incident came to light during Prosser's re-election campaign earlier this year. Prosser admitted to using the word "bitch," but said it was justified. "I probably overreacted, but I think it was entirely warranted," he said in March.

Why did Prosser think it was warranted? "They (Abrahamson and Justice Ann Walsh Bradley) are masters at deliberately goading people into perhaps incautious statements. This is bullying and abuse of very, very long standing," Prosser claimed.

That's the same Ann Walsh Bradley with whom Prosser allegedly got in a new argument last week, in her chambers, where his hands ended up around her neck, in the presence of other justices, in the midst of their deliberations over the legality of Gov. Scott Walker's union-busting bill. Presumably because she was bullying and abusing him again.

            2. NO ONE issued an immediate denial about the event -as any innocent person would have.

I have no doubt whatsoever that he did it.

What I want to know is why the victim has taken no action as of yet.

Justice Walsh Bradley released a statement late Saturday night confirming the allegations against Prosser. An investigation is in process i believe. Honestly, though, expect a shroud of silence until the matter is fully investigated. This wont be as poorly executed as the scandal with Weiner and Breitbart.
