  •  That would be Justice Bradley then (0+ / 0-)

She's the one who sent emails saying that she'd had it with Justice Prosser. She's the one who'd been extremely frustrated and couldn't contain her anger. She headed towards him with her fists raised when he apparently refused to leave her office.

That's instigating the violence. He protected himself from the perceived threat he faced, based upon the eyewitness testimony we have. Another justice reported said that he didn't choke her at the time in response to Bradley saying that she had been choked. That sure makes it sound like her claims that she was choked or held in a chokehold were exaggerated, and that his hands, in a defensive posture, simply hit her neck. Likely his thumbs hit her throat, and made her very uncomfortable. That's not the same as being in a chokehold.

Of course, we don't have all the evidence, but given the evidence we do have, it'd be Bradley, not Prosser, who'd be a goner. People get to use reasonable force to deter an assault. That's what it appears that Prosser did. Now, he's an asshole, and he certainly provoked her, but she had an obligation to not escalate a battle of words into a physical confrontation.
