    This is the major problem.  Students, administrators, and teachers are frequently allowed to do things which are, in fact, illegal; harassment, assault, battery, stalking, death threats, stuff which gets you restraining orders if you're an adult.

    Unfortunately in most schools they just tolerate this.  Sometimes they punish people who demand justice!

    This is the single largest problem with schools in this country.  Most are little Soviet zones of injustice, abuse, and corruption.  Simply eliminating their special privileges and applying the law in them exactly as we'd apply it in the rest of the world would be an improvement.

      I work in a public school, and there is a ton of oversight. However, it depends on staff and admins working together. The "cracks" that things like this can "fall through" (I hate that metaphor) are gaping chasms, and if the staff doesn't pull together to address bullying and terrorizing kids, then stories like this can happen every single day. If you have an administration that decides, for example, that terrorizing gay kids is okay, then it will happen regardless of what individual staffers decide to do about it -- and many staffers, either because of their own antigay status or because of cowardice, will not intervene. In my last school, we had three admins. If they had not been committed to combating bullying, our school would have been a combat zone. You always, always look to the admins first to see why behaviors at a school are not being addressed.
