    has changed in ways that make the FCC much less relevant.

    The FCC can regulate over-the-air broadcasting because, under Federal law, the radio frequency spectrum is public property. Cable and satellite networks are not.

    There is no way to allow for government regulation of private networks without running foul of the 1st Amendment.
