"Neither House may take a break of more than three days without the consent of the other."

"Most recently, in 1993, a Justice Department brief implied that the President may make a recess appointment during a recess of more than three days."

"Although President Theodore Roosevelt once made recess appointments during an intersession recess of less than one day, the shortest recess during which appointments have been made during the past 20 years was 9 days."

don't you mean? How could the President miss an opportunity he doesn't have because of obstructionism?
Maybe you didn't read the NYTimes link above, plus the fact that the Senate needs House approval to recess.
