Posting a Diary Entry

Daily Kos welcomes blog articles from readers, known as diaries. The Intro section to a diary should be about three paragraphs long, and is required. The body section is optional, as is the poll, which can have 1 to 15 choices. Descriptive tags are also required to help others find your diary by subject; please don't use "cute" tags.

When you're ready, scroll down below the tags and click Save & Preview. You can edit your diary after it's published by clicking Edit Diary. Polls cannot be edited once they are published.

If this is your first time creating a Diary since the Ajax upgrade, before you enter any text below, please press Ctrl-F5 and then hold down the Shift Key and press your browser's Reload button to refresh its cache with the new script files.

ATTENTION: READ THE RULES.

  1. One diary daily maximum.
  2. Substantive diaries only. If you don't have at least three solid, original paragraphs, you should probably post a comment in an Open Thread.
  3. No repetitive diaries. Take a moment to ensure your topic hasn't been blogged (you can search for Stories and Diaries that already cover this topic), though fresh original analysis is always welcome.
  4. Use the "Body" textbox if your diary entry is longer than three paragraphs.
  5. Any images in your posts must be hosted by an approved image hosting service (one of: imageshack.us, photobucket.com, flickr.com, smugmug.com, allyoucanupload.com, picturetrail.com, mac.com, webshots.com, editgrid.com).
  6. Copying and pasting entire copyrighted works is prohibited. If you do quote something, keep it brief, always provide a link to the original source, and use the <blockquote> tags to clearly identify the quoted material. Violating this rule is grounds for immediate banning.
  7. Be civil. Do not "call out" other users by name in diary titles. Do not use profanity in diary titles. Don't write diaries whose main purpose is to deliberately inflame.

Please begin with an informative title:

First of all, had BP, Transocean, and/or Halliburton not committed criminal negligence in order to maximize profits, the massive environmental catastrophe that was the Deepwater Horizon explosion/Macondo well blowout and oil spill in the Gulf of Mexico would never have happened. Ahead of that, had United States regulators denied permission to drill or had they applied more thorough oversight, they could have precluded or reduced the risk. That said:
Transocean Turns on BP With Scorching Oil-Spill Document
By SABRINA CANFIELD, Courthouse News Service, March 04, 2013

NEW ORLEANS (CN) - BP prolonged the Gulf of Mexico oil spill by two months by concealing the rate of oil flowing from the broken Macondo well, Transocean claims in a document filed in the damages trial. [...]

Transocean wrote in a heavily redacted "supplemental answer and affirmative defenses" that "BP's fraud was the proximate, intervening and superseding cause of the well continuing to flow until mid-July 2010. BP's misrepresentation and concealment of material information about the flow rate caused source control decision-makers to approve proceeding with the top kill over the BOP-on-BOP strategy in mid-May 2010. Because of that, a well that could have been capped in early May 2010 emitted tens of thousands of barrels per day for another two months causing significant environmental pollution." [...]

Transocean claims that BP's motive was to keep the true flow rate hidden, to minimize environmental fines, which are assessed by the barrel.

BP intentionally underrepresented the oil flow rate by as much as two orders of magnitude, in order to throw the game on their later monetary liability. In so doing, they turned a one-month spill into a three-month one. Knowingly and on purpose. Picture that: the spill could have been over and done with in one horrible month, not an interminable three.

While a few BP employees faced criminal charges, and while the courts are yet to decide the full scope of BP's financial liability, the fact that BP continues to do business in the United States and is even drilling in the Gulf of Mexico again is an absolute outrage.

Intro

You must enter an Intro for your Diary Entry between 300 and 1150 characters long (that's approximately 50-175 words without any html or formatting markup).

And don't even get me started on dispersants.

Of course, keep in mind that this news comes out of Transocean's attempt to optimize its position in court.
