Posting a Diary Entry

So copp fucks up and enters your plates wrong into his computer while he is following you right? Then pulls you over cause the plates don't match up with your car. Can he then arrest you if you are breaking the law?

I always thought that if you didn't do anything wrong, they weren't supposed to be able to pull you over.  I guess I can toss that notion in the bin with the type writer, and the push lawn mower.

The State Bar Of Wisconsin reports that in State v. Laufer:

“[T]he objective facts related by the officer supported a reasonable, if mistaken, suspicion that Laufer was driving a vehicle displaying incorrect plates based on the registration check he ran on the misread plates,” wrote Judge Lisa Neubauer for a three-judge appeals panel.

“We therefore adopt the reasoning set forth in Reierson and uphold the stop based on a good-faith mistake of fact in this case,” Judge Neubauer explained.

The appeals court explained that in general, police officers cannot make traffic stops without a reasonable belief that a violation of law has been or will be committed. If an officer is mistaken about the law, there can be no probable cause. Mistakes of fact are different.

So in other words, the copp needs to make up a story that sounds good.

The State v. Reierson case that was cited went something like this:

In that case, the officer stopped a vehicle thinking the license plates were expired. The plates were not expired, and the defendant was ultimately convicted for OWI, third offense.
Now because that dude was convicted of his third OWI offense, the BAL for him is .02 for the rest of his life.

I think that is bullshit, cause he aint drunk at .02. Silly me for think somebody needed to be intoxicated to get convicted for Operating while intoxicated.

Here's the thing, copps lie about shit in court.

They shouldn't be able to just make up some bullshit story, so they can pull over whoever they want for no reason and harass people they don't like.
