The testimonial certainty of an expert on the witness stand isn't always worth $400.00 an hour, unless it is your expert.
Dr. Di Maio took the stand today. He testified that he believes that Trayvon Martin's gunshot wound was consistent with Trayvon leaning over Zimmerman when the shot was fired, suggesting that the evidence supported Zimmerman's account of the events. Zimmerman claims that Martin was mounted on top of him when he fired the shot. I strongly disagree with Dr. Di Maio. The evidence ONLY shows that Trayvon was leaning over THE GUN when the shot was fired.
There is a scenario that could be constructed that could show how this shot could have been fired while both individuals were standing. For instance:
At some point during this tussle, both individuals slip on the wet grass and Zimmerman hits the back of his head on the sidewalk. They get back to their feet. Zimmerman has a hold of Martin's clothing to restrain him, and Martin is screaming for help. Both individuals are facing each other, Zimmerman still has his grip on Martin’s clothing with his left hand, and then draws his gun with his right. Martin pulls backwards to try to get away after seeing the pistol. This causes Martin to lean forward over Zimmerman’s gun, his clothing to fall, or be pulled away, from his body. Zimmerman fires a round into Martin’s chest at close range. Martin stops screaming, falls to the ground face down, and Zimmerman gets on top of him to secure the scene.
I think it is called "consistent with", Dr.
