Kansas Secretary of State Kris Kobach is having a truly terrible week. Yesterday, he was informed that he will face a contempt of court hearing before the federal bench. Today, Kobach lost again, and the ruling significantly impacts his planned 2-tiered voting.

Judge Larry Hendricks extended an order that previously allowed some 17,500 individuals who had registered at Division of Motor Vehicle offices but hadn’t provided documents proving their citizenship to vote in the August primary.
Federal court orders had previously granted these individuals the ability to vote in federal races, but Hendricks’ order guarantees they will be able to cast ballot in state and local races in the general election as well.

Registration efforts in Kansas have often been complicated as voters were forced into providing additional documents or applying to vote twice, if they had originally submitted the federal form. Kobach had originally proposed this two track voting scheme in order change the electorate for state house, senate and Gubernatorial elections.
The announcement from Judge Larry Hendricks comes as a blow to Kobach’s legal arguments regarding the division of voter rights.
